This Order & Delivery Policy (“Policy”) governs the placement, processing, delivery, and acceptance of orders placed by merchants (“Merchant”, “you”) on www.bulkbasketindia.com , mobile applications, or assisted/offline sales channels (collectively, the “Platform”). This Policy shall be read in conjunction with the Terms & Conditions, Credit Policy, Wallet Terms, and Privacy Policy of Bulk Basket India Food Solutions Private Limited (“BBI”, “Company”).
ORDER PLACEMENT
- Orders may be placed through: Website or mobile application Assisted sales (phone, WhatsApp, sales representative)
- All orders placed by the Merchant constitute purchase requests and are subject to acceptance by BBI.
- Orders are accepted subject to: Product availability Price confirmation Credit approval (where applicable) Operational feasibility
- BBI reserves the right to accept, modify, partially fulfil, or reject any order at its sole discretion without assigning reasons.
ORDER CONFIRMATION
- Order confirmation may be communicated via: Platform notification Email SMS WhatsApp Sales representative confirmation
- Only confirmed orders shall be processed for dispatch. 2.3 Once confirmed, an order cannot be cancelled or modified, except at BBI’s sole discretion
PRICING APPLICABLE TO ORDERS
- Prices applicable shall be those: Displayed on the Platform at the time of order confirmation; or Communicated and confirmed by BBI through assisted sales
- Prices are exclusive of GST unless stated otherwise.
- BBI reserves the right to correct pricing errors or revise prices prior to order confirmation.
DELIVERY TIMELINES
- Delivery timelines provided are indicative only and not guaranteed.
- Delivery timelines may vary due to: Product availability Weather conditions Traffic or logistics constraints Force majeure events Merchant location and access conditions 4.3 Delay in delivery shall not entitle the Merchant to cancellation, refund, or compensation, except as expressly decided by BBI.
DELIVERY ATTEMPT, ACCESS & LOCATION
- Delivery shall be attempted once at the Merchant’s designated delivery address.
- The Merchant must ensure: Correct delivery address Availability of authorised personnel Reasonable assistance for unloading Unrestricted entry and access to premises
- shall not be responsible for delivery delays or failures caused due to: Restricted entry Security protocols Society, hotel, or institutional access limitations Lockdowns, curfews, or internal rules at the Merchant’s premises
- delivery cannot be completed due to Merchant-related reasons: Goods may be returned or recalled The order shall be treated as delivered No refund or credit shall be issued Additional charges may be levied
PARTIAL DELIVERY
- BBI may, at its discretion, deliver an order in part where full fulfilment is not feasible due to: Stock shortages Quality rejections Operational or logistical constraints
- Such partial delivery shall be deemed valid delivery, and the Merchant shall be liable to pay for the Goods so delivered.
- Balance quantities, if any, may be delivered subsequently or cancelled at BBI’s discretion.
DELIVERY HOURS
- Deliveries shall be made during operational hours as determined by BBI.
- Exact delivery time slots are not guaranteed.
INSPECTION & ACCEPTANCE OF GOODS
- The Merchant must inspect Goods at the time of delivery for: Quantity Visible damage Obvious quality defects
- Any shortage or defect must be reported immediately at the time of delivery.
- Failure to raise objections at delivery shall constitute unconditional acceptance of the Goods.
PERISHABLE, WEIGHT-BASED & SENSITIVE GOODS
- Perishable Goods include fruits, vegetables, dairy, bakery, frozen items, meat, poultry, seafood, and similar products.
- The Merchant acknowledges that: Minor variations in size, weight, colour, or appearance are natural Goods sold by weight may have minor weight variations due to handling, trimming, or natural factors
- Such variations shall not be treated as shortage, defect, or non-delivery.
- No return, refund, or replacement shall be issued for: Perishable Goods accepted at delivery Deterioration due to delayed acceptance, improper storage, or handling by the Merchant
RETURNS & REVERSE PICKUP
- Returns shall be accepted strictly in accordance with BBI’s Return Policy, if applicable.
- Reverse pickup requests must be raised within seven (7) days from the date of delivery.
- Reverse pickup: May be clubbed with a fresh order; and Is subject to operational feasibility
- BBI’s decision regarding returns, replacements, or credits shall be final and binding.
DELIVERY FAILURE & REFUSAL
- In case of delivery failure or refusal due to Merchant-related reasons: The order shall be treated as delivered No refund or credit shall be issued Outstanding invoice value shall remain payable
- Re-delivery, if permitted, may attract additional charges.
INVOICING
- A valid GST tax invoice shall be issued at the time of delivery.
- Invoice value shall be payable: Immediately for prepaid orders; or Within the applicable Credit Period for credit orders
FORCE MAJEURE BBI
FORCE MAJEURE BBI shall not be liable for delay or failure in delivery caused by events beyond its reasonable control, including: Natural disasters Strikes or labour disruptions Government actions or restrictions Supply chain interruptions
LIMITATION OF LIABILITY
- BBI shall not be liable for indirect, incidental, or consequential losses.
- BBI’s maximum liability shall not exceed the value of the specific order giving rise to the claim.
MODIFICATIONS BBI
MODIFICATIONS BBI reserves the right to modify this Policy at any time. Updated versions shall be effective upon publication on the Platform.
GOVERNING LAW & JURISDICTION
This Policy shall be governed by the laws of India. Courts at Chandigarh, India shall have exclusive jurisdiction.
